AB 104 & 130 Updates

  • On Thursday, July 1, 2021, Governor Newsom signed Assembly Bill 104  into law.  On July 9, 2021, Governor Newsom also signed Assembly Bill 130 into law. We would like to provide you with important information on how this legislation may relate to your student. AB 104 contained three major provisions:grading, graduation policies, and  retention.  AB130 addresses student access to Independent Studies for the school year 2021-2022. 

     

    Graduation Requirements (AB104)

    Mandates that school agencies exempt all students who were in the 11th and 12th grade during the 2020-2021 school year and not on track to graduate in four years, from any and all local graduation requirements in excess of the statewide requirements specified in Education Code §51225.3. Please contact your school site for more information.

    Retention (AB104)

    Parents of eligible students may request to retain their student for the 2021-22 school year. Students who received a “NM” (No Mark) in at least half of their courses (6 semesters or more) during the 2020-21 school year are eligible.

    Grade Change (AB104)

    Parents/guardians and adult students may request that high school grades earned during the 20-21 school year be changed from a letter grade to Pass or No Pass. Deadline is August 14, 2021.

    Independent Study (AB130)

    For the 2021-22 school year, Local Education Agencies must offer an independent study option to students and families to be made available to students whose health would be put at risk by in-person instruction, as determined by the parent or guardian.
